Question: Can a graduate of an OT program work legally in Michigan as an OT after failing the NBCOT Certification exam?
Answer: Legally, yes, a graduate of an OT educational program who has failed the NBCOT registration exam can work in the field while preparing to re-take the exam.

They would be functioning like an OT aide, and would require a high level of direct supervision. Tasks delegated to an OT graduate who has not passed the certification exam should be routine in nature and not highly complex clinically. This is similar to the type of deligation for an OT Aide. Their employer and/or supervising OT would also want to be assured that they are competent by personally establishing their ability to perform any activities delegated to them safely and effectively. The supervising OT would be legally responsible for all services that they would perform.
